Terms of Service Canada

Welcome to SCRUPS. We make the most unbelievably comfortable scrubs you will ever wear. SCRUPS move with your body, support your pace and keep you comfortable through all the moments that make up your day. 

By accessing our website or purchasing from SCRUPS, you agree to the following Terms.

If you don’t agree, please don’t use the site or place an order.

1. Who We Are

These Terms apply to SCRUPS and its affiliates (“SCRUPS,” “we,” “us,” “our”) and to you (“you,” “your”) as a visitor, customer, or account holder.

2. Canada Only 

SCRUPS currently sells and ships within Canada only.

If and when we expand to other countries, we’ll update these Terms and may publish additional region-specific terms. Until then, these Terms apply to purchases made for delivery within Canada.

Orders placed on SCRUPS.com are currently shipped within Canada. We work with trusted Canadian carriers, including Canada Post, to deliver your order safely and reliably.

3. Eligibility

By using our site and placing an order, you confirm that:

  • You are the age of majority in your province or territory, and

  • You have the legal capacity to enter into a binding agreement, and

  • If you are ordering for an organization, you have authority to bind it.

  • You are using the site for personal or organizational purposes, as applicable.

4. Accounts

You can browse without an account. If you create one, you agree to provide accurate, current information and keep your login confidential.

You’re responsible for activity under your account unless prohibited by law.

5. Products, Content, and Accuracy

We work hard to show our products accurately. Still:

  • Colours may look different on different screens

  • Product details can change

  • Items may be limited, out of stock, or discontinued without notice

Minor colour variation due to dye lots, lighting, or screen display is not a defect. Shrinkage or wear due to failure to follow care instructions is not a defect. Fit is subjective; please consult the size guide before ordering.

We may correct errors (including pricing or description errors) at any time.

If your item has a manufacturing defect, we will make it right. “Manufacturing defect” means a fault in materials or workmanship (e.g., seam failure under normal wear, zipper failure, or fabric defect) and does not include normal wear and tear, damage caused by misuse, accidental damage, improper laundering/care, alterations, or size/fit preference. Contact us within 7 days of delivery with (i) your order number, (ii) photos of the issue, and (iii) a brief description of when/how the issue occurred. After review, we will provide, at our option, a repair, replacement, or refund for the affected item(s). For approved defect claims, we may provide a prepaid return label or request additional verification.

6. Prices, Currency, Taxes

All prices are listed in Canadian dollars (CAD) unless stated otherwise.

Taxes (GST/HST/PST/QST) and shipping charges are calculated at checkout. Because SCRUPS currently ships within Canada only, customs duties generally do not apply. If this changes, we will update these Terms and display any applicable duties/fees at checkout.

7. Orders and Acceptance

When you place an order, you are making an offer to purchase. We may accept, decline, or limit orders at our discretion, including to prevent suspected fraud or resale.

An order is considered accepted when we ship it (not when you receive an order confirmation email).

If something you ordered is unavailable, we’ll contact you and work with you in good faith. If we can’t fulfill an item, we’ll refund that item.

8. Payment

We accept the payment methods shown at checkout. By submitting payment, you confirm you’re authorized to use that payment method.

If your payment can’t be processed, your order may be cancelled.

If you have an issue with an order, contact us first so we can try to resolve it. If you initiate a chargeback without first giving us a reasonable opportunity to help, we may suspend your account and decline future orders. You authorize us to provide your order details, delivery confirmation, and communications to your bank/payment provider to respond to disputes.

9. Shipping, Delivery, and Risk of Loss

At this time, we ship within Canada only.

Delivery timelines shown on the site or in emails are estimates, not guarantees. Delays can happen, especially during peak seasons or due to events outside anyone’s control.

If tracking shows “delivered” but you did not receive the package, contact us within the delivery issues window. We may require a signed statement and/or additional verification to investigate. Where appropriate, we will work with the carrier to investigate; outcomes depend on carrier findings and fraud-prevention checks.

We currently ship using trusted Canadian carriers, including Canada Post. Delivery timelines, package size and weight limits, delivery attempts, and service interruptions may be affected by the carrier’s operational guidelines and circumstances outside our control.

SCRUPS is not responsible for delays, service interruptions, or delivery limitations caused by carriers, weather, labour disruptions, incorrect or changed addresses or other events beyond our reasonable control; however, we will assist you in working with the carrier to locate and deliver your shipment.

If tracking shows a shipment has not been delivered or appears lost, contact us within 10 business days after the later of (i) the carrier’s “expected delivery” date shown in tracking, or (ii) our estimated delivery window communicated at checkout. We will open a carrier investigation. A package will be treated as “lost” when the carrier confirms it cannot be located or delivered. If confirmed lost, we will provide, at our option, a replacement or refund for the affected item(s), subject to product availability and fraud-prevention checks. This does not limit rights that cannot be excluded under applicable consumer protection laws.

10. Returns and Exchanges

Returns and exchanges are governed by our Return Policy, which is incorporated into these Terms by reference.

Some items may be final sale or ineligible for return (for example, customized or embroidered items).

We will issue return instructions after receiving your request. Returns must be shipped within 10 business days after we send instructions, unless we agree otherwise in writing. 

11. Promo Codes and Offers

Promotional offers, discount codes, and gift cards may be subject to additional terms and conditions posted on the Site or provided at the time of issue. To the extent any promotion or gift card terms conflict with these Terms, the posted promotion/gift card terms will govern for that specific offer. 

12. Resale Restrictions

SCRUPS products are made for the people wearing them. Products are sold for personal or organizational use and not for unauthorized resale. We may limit quantities, cancel orders, restrict accounts, or refuse service where we reasonably believe orders are placed for commercial resale, fraud, abuse of promotions, or other conduct that violates these Terms or harms SCRUPS or its customers.

13. Intellectual Property

All site content (logos, designs, text, videos, photos, graphics) belongs to SCRUPS or our licensors and is protected by intellectual property laws.

You may not copy, reproduce, or use it for commercial purposes without written permission.

14. Your Content (Reviews, Photos, Submissions)

If you post or share reviews, photos, or other content, you grant SCRUPS a non-exclusive, royalty-free, worldwide right to use it for marketing and promotional purposes. This includes testimonials, stories and images shared. We always aim to use community content respectfully.

SCRUPS has all rights and permissions to submit the content (including from any individual shown), and that our use will not violate third-party rights.

You may request we stop using specific content in future marketing by contacting support; we will use commercially reasonable efforts to honor requests, subject to content already in circulation (e.g., printed materials or paid ads already live).

15. Prohibited Use

Please don’t:

  • Misuse the site

  • Attempt to access restricted systems

  • Introduce malware or harmful code

  • Scrape or harvest data

  • Impersonate others or misrepresent affiliation

We may suspend or terminate access if we reasonably believe these Terms have been violated.

16. Disclaimers

SCRUPS products are apparel designed for comfort, durability, and everyday performance. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Any statements about comfort, durability, fabric performance, or antimicrobial features describe the intended characteristics of the materials and are not medical claims. Where we make a specific performance or efficacy claim, it is based on appropriate testing or substantiation.

To the fullest extent permitted by applicable law, the SCRUPS website, products, and services are provided on an “as is” and “as available” basis, without warranties or conditions of any kind, whether express or implied.

Nothing in these Terms excludes, limits, or waives any consumer rights that cannot be excluded under applicable Canadian or provincial consumer protection laws.

17. Limitation of Liability

To the fullest extent permitted by law, SCRUPS will not be liable for indirect, incidental, special, consequential, or punitive damages. Nothing limits liability for fraud, willful misconduct, gross negligence, or for death/personal injury caused by negligence where such limitation is prohibited. Where permitted, SCRUPS’ total liability for any claim relating to a product will not exceed the amount paid for the product giving rise to the claim.

18. Indemnification

You agree to indemnify SCRUPS from third-party claims arising from (i) your unlawful use of the Site, (ii) your violation of these Terms, or (iii) content you submit, but only to the extent caused by your acts or omissions. SCRUPS will provide notice and reasonable cooperation, and you may not settle any claim imposing obligations on SCRUPS without SCRUPS’ written consent.

19. Privacy

Our Privacy Policy follows the Personal Information Protection and Electronic Documents Act (PIPEDA) and explains how we collect, use, and protect personal information. By using our site, you agree to our Privacy Policy.

20. Accessibility

SCRUPS is committed to providing an accessible and inclusive online experience for everyone.

We strive to ensure that our website and digital services are designed and maintained in accordance with applicable accessibility laws and standards.

Accessibility is an ongoing process. While we work to maintain and improve accessibility across our site, we recognize that some areas may not yet be fully accessible.

If you experience any difficulty accessing our website, placing an order, or using any of our services, please contact us and we will work with you in good faith to provide support or an alternative solution.

Our approach to accessibility, including how we receive and respond to accessibility feedback, is outlined in our Accessibility Statement, which is available in our Privacy Policy.

21. Force Majeure

We’re not responsible for delays or failure to perform caused by events beyond our reasonable control, like natural disasters, carrier disruptions, supply chain interruptions, or outages.

22. Governing Law

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of laws principles. Subject to applicable consumer protection laws, the parties attorn to the exclusive jurisdiction of the courts located in Ontario, Canada.

Before starting a claim, you agree to contact us at support@scrups.com and allow 30 days to try to resolve the issue informally. Except where prohibited by applicable consumer protection laws (including in Quebec), any legal action must be brought in the courts located in Ontario, Canada, and you and SCRUPS attorn to that jurisdiction.

23. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted. Your continued use after updates means you accept the updated Terms.

24. Entire Agreement

These Terms, together with any policies or documents they expressly incorporate by reference (including our Shipping & Returns Policy and Privacy Policy), constitute the entire agreement between you and SCRUPS regarding your use of the Site and purchases from SCRUPS, and supersede all prior or contemporaneous communications, understandings, or agreements, whether written or oral, relating to the same subject matter.

25. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

26. No Waiver

SCRUPS’ failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. Any waiver must be in writing and signed by SCRUPS to be effective.
